Medical missions to provide cardiac surgical procedures in developing and technologically less advanced countries is a great challenge. It is also immensely gratifying, personally and professionally. Such missions typically present significant ethical dilemmas, especially making difficult choices, given limited time and resources, and the inability to help all children in need of cardiac surgery. We describe some of these issues from our perspective as visiting cardiologists.

Conspiracy theories (CTs) are widespread ways by which people make sense of unsettling or disturbing cultural events. Belief in CTs is often connected to problematic consequences, such as decreased engagement with conventional political action or even political extremism, so understanding the psychological and social qualities of CTs belief is important. CTs have often been understood to be “monological”, displaying the tendency for belief in one conspiracy theory to be correlated with belief in (many) others. Explanations of monologicality invoke a nomothetical (...) or “closed” mindset whereby mutually supporting beliefs based on mistrust of official explanations are used to interpret public events as conspiracies, independent of the facts about those events (which they may ignore or deny). But research on monologicality offers little discussion of the content of monological beliefs and reasoning from the standpoint of the CT believers. This is due in part to the “access problem” (Wood & Douglas, 2015): CT believers are averse to being researched because they often distrust researchers and what they appear to represent. We used several strategies to address the access problem, and investigated the symbolic resources underlying CTs by reconstructing a conspiracy worldview - a set of beliefs held by CT believers about important dimensions of ontology, epistemology, and human agency. To do this, we analysed media documents, conducted field observation, and engaged in semi-structured interviews,. We describe six main dimensions of a conspiracy worldview: Views of the nature of reality, the self, the outgroup, the ingroup, action, and the future. We also describe a typology of five types of CT believers, which vary according to their positions on each of these dimensions. Our findings converge with prior explorations of CT beliefs but also revealed novel aspects: A sense of community among CT believers, a highly differentiated representation of the outgroup, a personal journey of conversion, variegated kinds of political action, and optimistic belief in future change. These findings are at odds with the typical image of monological CT believers as paranoid, cynical, anomic and irrational. For many, the CT worldview may rather constitute the ideological underpinning of a nascent pre-figurative social movement. (shrink)

Despite the challenges associated with virtually mediated communication, remote collaboration is a defining characteristic of online multiplayer gaming communities. Inspired by the teamwork exhibited by players in first-person shooter games, this study investigated the verbal and behavioral coordination of four-player teams playing a cooperative online video game. The game, Desert Herding, involved teams consisting of three ground players and one drone operator tasked to locate, corral, and contain evasive robot agents scattered across a large desert environment. Ground players could (...) move throughout the environment, while the drone operator’s role was akin to that of a “spectator” with a bird’s-eye view, with access to veridical information of the locations of teammates and the to-be-corralled agents. Categorical recurrence quantification analysis was used to measure the communication dynamics of teams as they completed the task. Demands on coordination were manipulated by varying the ground players’ ability to observe the environment with the use of game “fog.” Results show that catRQA was sensitive to changes to task visibility, with reductions in task visibility reorganizing how participants conversed during the game to maintain team situation awareness. The results are discussed in the context of future work that can address how team coordination can be augmented with the inclusion of artificial agents, as synthetic teammates. (shrink)

This ain’t your grandma’s virtue theory.In Michael Austin’s bold new collection, Virtues in Action: New Essays in Applied Virtue Ethics, gone are the pretentions of defining right action generically as what a virtuous person would do in the circumstances, while acting in and from character, provided that a virtuous person would end up in those circumstances. Instead, we find detailed explorations of specific virtues and vices related to specific fields of activity and problems, with attention (some of it (...) careful – some less so) to relevant empirical literature and elbowroom for alternative normative approaches and conceptions. Mark Coeckelbergh starts his book with a very powerful picture based on a real incident: On the 9th of January 2020, Robert Williams was wrongfully arrested by Detroit police officers in front of his two young daughters, wife and neighbors. For 18 hours the police would not disclose the grounds for his arrest (American Civil Liberties Union 2020; Hill 2020). The decision to arrest him was primarily based on a facial detection algorithm which matched Mr. Williams’ driving license photo (...) with the picture of a man who was suspected of watch theft two years earlier. Not only did the computer ‘get it wrong’ as one of the detectives said, when Mr. Williams made them aware that the picture of the suspect obviously wasn’t resembling him, the probably unreliable algorithm very likely contributed to racial discrimination (Hill 2020). It is well documented that many available facial detection algorithms at this time had significant problems (e.g. a comparably high false positive rate) with respect to black persons, like Mr. Williams (NIST 2019). Multiple causes may exist, such as unbalanced training datasets and insufficient optimization. Coeckelbergh compares the disturbing case of Mr. Williams with a political interpretation of Franz Kafka’s The Trial, where the protagonist, Josef K., is accused of an unspecified crime by an opaque, oppressive and absurd bureaucracy: “In the 21st-century United States, Josef K. is black and is falsely accused by an algorithm, without explanation” (p. 2). James Greenaway’s new book aims to address this (...) issue by offering an original and penetrating exploration into the philosophical meaning of this difficult and laden term. At the heart of his approach lies the concept of the metaxy. As explained in Plato’s Symposium and expanded by Eric Voegelin, it is a state of being-in-tension between two static states or “poles,” which can represent wisdom and ignorance, need and plenty, transcendence and immanence, eternity and time, and so forth. This becomes the foundation for Greenaway’s “hermeneutic of belonging,” which consists of two forces: “existence-from” and “existence-toward.” Existence-toward is a sort of intentionality, a consciousness of “someone or something with whom I am experiencing some kind of an affinity.” It is the “where” or “with whom” I desire to be. Existence-from is an awareness [End Page 717] of the other that a person carries within him- or herself: persons, communities, places, times that are “so significant that I cannot be who I am without them.” Greenaway argues that belonging in the abstract hinges on the metaxic tension between these two poles, variously conceived depending on the context.The second section of the book examines the different contexts in which existence-from and existence-toward play out within each person: between oneself, other persons, and the cosmos. These constitute the various aspects of what Greenaway calls “presence.” Belonging on this level means each person participates “in the grand, continual emergence of reality in all of its variety.” Presence to myself, to others, and to the cosmos as a whole reflects the metaxic tension of the hermeneutic of belonging.In the final section, Greenaway turns to explaining how belonging works in community. He begins by differentiating between the communion, or “bond and order” of a community, and communitas, the “shoulder-to-shoulder stance” that permeates political existence. Communion is a manifestation of the aforementioned hermeneutic of belonging within and among persons and the cosmos. It is the more fundamental principle of community that reflects the primordial intersubjectivity of Buber’s I–Thou: In some sense, each person is or must be involved in or available (in the sense of Gabriel Marcel’s disponibilité) to the other. Without some sort of grounding in communion, communitas becomes impossible. By contrast, communitas is the jostling, back-and-forth movement associated with the practical discernment and attainment of common political goods that Greenaway conceives, with St. Augustine, as objects of common love. These are sought out, argued about, and even fought over in everyday political life, which is marked by a shared commitment to achieving the goals associated with common political goods. The communitas is centered in the tension of belonging between the more fundamental recognition of each person as a bearer of meaning in the cosmos and the everyday business of collectively discerning and implementing the common good.But communion carries a further meaning. In addition to the more fundamental respect for myself and all others in the community as bearers of presence, it is also an awareness of all possible transcendent perfections of the community as a whole. Greenaway calls this second sense “sacramentality.” Yet this mysterious perfection is not necessarily for the here-and-now. It is, rather, another example of the hermeneutic of belonging where transcendent principles intersect with temporal reality. Thus, every community is sealed with seeming contradictions that, far from being irresolvable paradoxes, illustrate its belonging-in-tension alongside mystery. According to the Gospel of Matthew, disciplemaking seems to be the signature mark of faithful disciples of Jesus the Christ. Van Aarde refers to this, with reference to Von Harnack and Lohmeyer as the manifesto of the church, being on the same level of meaning as Deuteronomy 6 in the Old Testament. It may be fair to say that this 'natural' way of being and doing was in more than one way exchanged for evangelism practices that did nothing to (...) show forth that following the Christ is a better or best way of living life, here already, to its fullest. These practices even reflected negatively on disciplemaking as such. A personal conviction is that 'discipling' may even be one of the missing links in the so-called missional conversation. This article will reflect on current theory on discipling and the natural necessity thereof. It will also draw upon findings in empirical research conducted by the National Church Life Surveys during 2014 in South Africa that may give an indication whether discipling is a common praxis among selected South African denominations and congregations. Fulford (bio)I am grateful to John Sadler and his colleagues for their generous invitation to contribute to this collection marking Philosophy, Psychiatry, & Psychology (PPP)'s thirtieth birthday. True to our editorial tradition of "no nonsense" publishing, the "ask" was a reflection on PPP's past, present and future, limited to 500 words. In fact, one word does it (...) for me—collegiality.Collegiality was our watch word from the start. I still treasure a group photo taken at an early pre-meeting of the Association for the Advancement of Philosophy and Psychiatry (AAPP) convened by Michael Schwartz at his home in 1992, when, among other initiatives, PPP was conceived through transferring our then-nascent journal proposal from a small British publishing house to its current international publisher, the Johns Hopkins University Press. Michael and I had met earlier by phone when he had called the Royal College of Psychiatrists in London to enquire about its recently launched Philosophy Group and (by mere chance) I happened to be standing next to the person who took the call! PPP, with John and myself its founder editors, was subsequently born as, and has remained, a joint venture between our two groups: and Peter Zachar's recent initiative in building closer links with the International Network for Philosophy and Psychiatry (INPP) has taken us an important step towards the vision shared by Michael, John and myself that PPP should grow to reflect and represent a global open society of philosophy and mental health.As a pointer to the future, this global open society was no mere utopian vision but a joint commitment to what we conceived as a necessary ambition. Contemporary disenchantment with the repeated failures of translation of current narrowly empirical models of psychiatry, points to the truth of our German colleague, Paul Hoff's, characterization of the history of psychiatry as a history of serial collapses into single message mythologies. This disenchantment might seem to offer an opportunity for colonial expansion of philosophy into psychiatry (a re-assertion, perhaps, of phenomenology?). But PPP was born out of the "decade of the brain" and has remained throughout an ally of, not competitor to, the neurosciences. [End Page 3] So, while it is true that, with Peter's initiative, and with editorial and other innovations introduced by John, PPP is actively extending its reach (to new areas of philosophy, and to new voices, informed notably by experience as well as by training), this expansion remains a collegial not colonial enlargement of the field. I need hardly point to the challenges presented by the inclusive ambitions of such enlargement (not least to maintaining the highest standards of editorial and peer review). But PPP's collegiality provides the foundation for the work needed to deliver on these challenges. In this paper we consider the use of cases in medical ethics research and teaching. To date, there has been little discussion about the consent or confidentiality requirements that ought to govern the use of cases in these areas. This is in marked contrast to the requirements for consent to publish cases in clinical journals, or to use personal information in research. There are a number of reasons why it might be difficult to obtain consent to use cases in ethics. (...) Many cases concern people who are incompetent, and thus unable to give consent. Often the material is of a sensitive nature, it is not clear who should give consent, or the ethicist has no access to those involved. We argue that the use of cases in ethics research and teaching can be justified by appeal to the public interest argument, and suggest a number of areas for discussion and clarification. (shrink)

INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. It is often observed that there is little or no moral philosophy in classical Indian Buddhist thought. This is sometimes believed to be surprising since obviously there is an ethical teaching in Buddhism and clearly there are other forms of Buddhist philosophy. In my view, there is something that can plausibly be called moral philosophy in Indian Buddhism, but it is not quite what many people have expected because they have approached the issue from a specific understanding of philosophy that (...) is too limited. I propose to defend this interpretation by reshaping Mark Siderits’ concept of fusion philosophy. The fusion I will propose reveals a form of moral philosophy that may be called self-cultivation philosophy. I will argue that this was a common activity in ancient Chinese, Greek and Indian cultures—including especially early Buddhist thought and practice. (shrink)

In his pioneering Caliban's Reason: Introducing Afro-Caribbean Philosophy, Paget Henry points out that because of the region's colonial history, Caribbean philosophy is far more often found ‘embedded’ in other discourses, such as literature, than in explicit theorising. Following Henry's lead, I seek to find the philosophical ‘moral of the story’ of Voices Under the Window, the 1955 first novel of the late Jamaican writer John Hearne, which some critics regard as his best work. In a novel with significant autobiographical elements, (...) Hearne, a ‘high-brown’ or ‘red’ Jamaican, recounts the story of Mark Lattimer, likewise a ‘red man’ positioned at the upper edge of the ‘brown’ stratum of the white/brown/black Jamaican social pyramid. Lattimer moves from a race-denying attempt to ‘pass’ in World War II Britain to a Marxist social activism upon his later return to post-war Jamaica, but is killed in a black protest riot. His tragic fate raises important philosophical questions about race, colour, class, and personal and social transformation that remain very relevant today, especially considering the failure of 1970s Anglo-Caribbean radicalism to fulfil its revolutionary promise. Peter Abbs begins by deploring “the cultural catastrophe” of British education in the mid-1990s. He states in his always lucid and accessible prose: “I want to come clean; I want (...) to place the general argument of the book in the current arena of public debate, and to do so without apology and without equivocation.” He bemoans today’s massive denial of spiritual energy, of intellectual enquiry, of aesthetic beauty and public virtue. In a better world, he says, education would serve, “willingly and lovingly... the transcendent ends” of culture and society. Abbs decisively rejects the “Cato” model where teachers are unquestioning skill-based technicians who employ [End Page 393] “managerial” language. Instead, he advocates a Socratic view, which is “to reaffirm that education should be primarily concerned with critical reflection, with personal development and with the sustained enquiry into the various forms of meaning.”Subsequent chapters apply this approach to the arts curriculum. Its failure to gain proper recognition and the absurd and continued conflation of Dance and Physical Education are indicted. Abbs convincingly attacks the notion of “self-expression” in art and language long upheld by educationalists. Its application at the expense of reason, abstract thinking, and the study of “the truly significant writers through the centuries” has in his view helped to trivialize and to marginalize the arts. Nowhere is this more apparent than in so-called “educational drama.” For three generations it has denied “the aesthetic field of drama, the symbolic field of its own form,” and has elevated one genre, improvisation, and made it the totality.Abbs is committed to reconciling “the creative energies of the individual and the creative energies of the culture.” Who would argue with that? And who could deny the value of critical reflection or indeed public virtue? He declares, rather ponderously: “The vested interests of Coca-Cola manufacturers or political missionaries have to be seen as too ‘recent and relevant’ to be allowed” to shape education. The Abbs academy requires “a formally protected place, an institutional space more like the theatre than Tesco [a supermarket chain], more like the cathedral than the Stock Exchange.” For all this patent seriousness and sincerity, here is an educationalist irrevocably and irreconcilably out of joint with the present. The austere modernism of Herbert Read profoundly influenced Abbs in his teens; he also admires F. R. Leavis, Richard Hoggart, and David Holbrook, whose writing at its most influential spans the 1930s and the 1960s. Abbs’s most recent source of inspiration is the art critic Peter Fuller, whose abiding legacy was a romantic nationalism that eloquently celebrated an “essentially symbolic and figurative” tradition in British art from J. M. W. Turner to Henry Moore.Modern Painters, which Fuller edited, could afford to eschew popular culture and its connections with “higher” arts. Fine for a periodical, but how could such a fastidious approach be applied to the classroom experience? Abbs describes an experiment that he performed on student-teachers at the University of Sussex to understand their aesthetic responses. Among the events and objects that the students were asked to consider were John Constable’s The Haywain, Richard Strauss’s The Four Last Songs, a visit to Claude Monet’s garden and a performance of Coriolanus. Abbs’s list does not, however, contain Pulp Fiction, a Courtney Love concert, or an S. E. Hinton novel. What place, if any, do the latter have in the arts curriculum? Must they be ruled out for being too “recent and relevant”? Can student responses to them be brought to bear on their comprehension of higher culture? Or is there a great and ultimately irreconcilable divide? Richard McCormick examines the concepts of postmodernity and postmodernism as they apply to West Germany, discussing them against the background of cultural and political upheaval in that country since the 1960s, rather than exclusively in the more familiar setting of intellectual history. Considering six literary and cinematic texts that are marked by a preoccupation with the self and subjectivity, he underscores the crucial influence of feminism on writers and filmmakers--and on the "postmodern." In a broad international context he describes the (...) conflicting forces that affected the West German student movementthe rationalistic tradition of the Weimar Left and more "irrational" influences such as French existentialism and surrealism (as well as the American "Beat" movement and rock & roll)--and shows how these forces played themselves out so that dogmatic Marxist Leninism was repudiated in favor of a "New Subjectivity.". At the center of the discussion are the novels Lenz by Peter Schneider, Class Love (Klassenliebe) by Karin Struck, and Devotion by Botho Strauss, and the films Wrong Move written by Peter Handke and directed by Wim Wenders, Germany, Pale Mother by Helma Sanders-Brahms, and The Subjective Factor by Helke Sander. We present the argument with two aims in mind. The first is to question the conventional wisdom, seldom challenged even by proponents of capital punishment, that being an abolitionist is closely connected to having a civilized respect for human life. This conventional wisdom, we hope to show, is somewhat off the mark. To this end we exhibit (...) structural similarities between so-called lifeboat dilemmas and the public's relationship to a murderer. In a lifeboat dilemma one must choose between saving this life or that, since the lifeboat will not hold both persons. Now if this life were an innocent's and that one a murderer's, a choice to save the latter would not be met with accusations of callousness towards human life. Some of the most powerful persons today are those most successful at convincing others they have the greatest claim to victimhood. This new, socio-political shift marks the rise of what recently has been called “victimhood culture.” This article addresses how certain Christian theological views on God’s wrath, along with differing appropriations of the church’s collective victimhood both have played significant roles in generating a “culture war of victimhood”—a mode of conflict in which individuals and parties fight for the status of (...) being the most socially oppressed and marginalized, especially for the purpose of gaining power. To better understand this collective intentionality of victimhood, the article provides a multidisciplinary exploration into recent works in sociology of religion, anthropology, and historical theology. This article investigates why Humboldtian Science, as a heuristic concept, has gained prominence in the historiography of science and requires clarification. It offers an ideal-type model of comparative research and exact measurements across vast spaces, which Susan F. Cannon and others tied to Alexander von Humboldt (1769–1859). Yet, he himself was less “Humboldtian” than this concept suggests. The article proposes to disentangle Humboldtian Science from Humboldt’s science, which constituted a set of individual research practices that defied the ideal of precision. (...) Humboldt’s science was often impromptu, marked by epistemological and personal insecurities, and embedded in the protagonist’s peripatetic way of living and frequently erratic writing style. Historicizing Humboldt’s science undermines the exceptionalism that elevates the Prussian savant above his contemporaries and casts him as a singular figure. This critical reflection encourages biographical approaches to the history of science, balancing heuristic generalizations and attention to individual research styles. (shrink)

This is a new critical latin edition, with facing English translation, of Peter Abelard’s ethical treatise, sometimes entitled "Know Thyself." The book is one in the series of Oxford Medieval Texts. Accompanying the latin text and simple, easy reading translation is a most helpful introduction by Luscombe which points out the historical importance of this little treatise as among the first finely articulated attempts at bringing the classical concerns with human virtues and character together with the theological concerns of a (...) believing Christian. Ethics deals with the problem of how we may properly speak of the moral formation of a person. Abelard’s treatment is more weighted toward the attitudes of man than the nature of his deeds. What is worked out, with the help of many suggestive examples and frequent reference to the religious practices of the twelfth-century church, is a crucial theory of intention and a definition of sin. He holds that our intention, measured to the standards of divine law, determines the morality of our actions : "We consider morals to be the vices or virtues of the mind which make us prone to good or bad works." Good and bad emerge from the struggle where there is consent to an act virtuously or viciously motivated. Morality does not come from the inclination since the constitution of man includes both his virtues and his vices; nor does it come from his acts since all acts are indifferent, before God, to good or bad. It is the intent or consent to act that is determinant. Sin, the other major theme, complementary to intention, is defined as contempt for God, i.e., "to do by no means on his account what we believe we ought to do for him." He founds his notions of morality on God as that good, the source and whole, such that "although... there is a number of good things so that goodness exists in plurality, it does not follow therefore that goodness is greater." By working out these notions, Abelard delivers an innovative morality of conduct for a man beset with a character marked with both virtues and vices, emphasizing man’s faculty of choice and underscoring his ability to know and be responsible to the divine law. Chappell Soka University Guiding Issues How do I understand my own identity as a religious person in light of the fact that I am open to the validity of the beliefs held by other traditions?Has my understanding of my own religious tradition been transformed, purified, and enriched by the (...) ways in which I have come to understand the other traditions?Have I been changed by the dialogue, or do I remain the same? What difference has the dialogue made in my life, personally or theologically?How would I respond to this topic from the point of view that I am a religious person engaged in a specific area of expertise (environment, philosophy, etc.)? Thesis The increased mobility and diversity of relationships in the contemporary world has often made religious identity a complex issue, hardening it for some people and diffusing it for others. But in either case, I wish to challenge the view that highlights beliefs as a key to defining identity and instead propose that many other factors might be more important, and that in religious life identity is a secondary issue. Being Christian I was born, baptized, and raised in the Christian tradition. My father was a United Church of Canada minister and I became a United Church of Canada minister, while my mother was a Baptist and my brother became a Baptist minister. Religious values were important in my upbringing and throughout my adult life. While I have maintained a concern for ultimate values, however, my own beliefs have undergone radical changes. I am sure that many in the Christian community would say that I am no longer a Christian, but I have never taken that view and have never taken the step to renounce my ordination as a Christian minister. Instead, I question the assumption that beliefs are the best way to define a religious life or religious identity. [End Page 9]In 1961 I had the good fortune to go to McGill University to study with Wilfred Smith, and from him I have learned not to focus on the "beliefs" of others—namely, intellectual constructs—but on the "faith" of others as much more encompassing and important. Some religious communities—like the Jain and the Confucian—do not care about one's beliefs, only about one's practice, both ritually and morally. Wilfred Smith called it orthopraxy, rather than orthodoxy, and it provides an alternative means of marking religious identity.Why should I feel bound by the efforts of Emperor Constantine when he convened a church council in 325 CE to define Christian identity or by subsequent efforts of church institutions to do the same? Today, my Christian identity is nurtured and expressed by a constellation of moral values and cosmic trust, of faith and actions, that are connected to the early Jesus movement, especially as articulated by John Dominic Crossan. Living as we do in the modern era, we have very different beliefs about history and cosmology from these early Christians, as John Robinson discussed forty years ago in his book Honest to God. My affection for Christian church life and the early Jesus movement involves other factors than the concerns of those who formed Christian creeds. The Trinitarian doctrine makes sense as a conglomeration made from the conceptualization of several historical experiences important in the early Christian community, but the Trinitarian concept does not clarify or enhance my contemporary experience.In spite of the Trinitarian formulation, I still honor and value the powerful and enduring influence of my Christian upbringing. As a result, I have not renounced the name "Christian" or my ordination as a Christian minister, even though I have grown increasingly away from them. In lieu of an abstract, here is a brief excerpt of the content:RECENT SACRAMENTAL THEOLOGY HIS ARTICLE continues and complements an earlier scussion of contemporary sacramental method pubhed in October, 1983, based on a review of eleven books published in English on the sacraments from 1975 to 1983.1 That article dealt specifically with approaches to "contemporary systematic reflection on the Christian sacraments, the relation of sacramental theology to other areas of theology, the impact of liturgical studies on sacramental studies, and (...) aspects of pastoral practice." 2 The final section described the elements that should be included in a contemporary approach to a systematic study of sacraments.3 The present article assesses seven more recent works in English on sacraments in general,4 again from the perspective of method. This is a vital move in the postconciliar church. It is as though we feel that we have enough sense of the shifting sands of time to use them in an hourglass to mark our age.5 Each of the books discussed here can be understood to propose a new general theory of sacramental life or a new approach to the systematic study of sacraments. The works by Cooke and Schanz are clearly intended as texts for college courses in sacramental theology. Martos's book offers an interdisciplinary approach to sacraments. James White offers a fresh look at the traditional dictum lex orandi, lex credendi on a level useful for pastors and seminary students. Gerard Fourez approaches sacraments from a social science perspective. David Power deals with symbol in liturgy and the relationship between sacramental study and contemporary culture. Patricia Smith offers a way of dealing with how to teach about sacraments in the contemporary context of evolving sacramental theories. Each book can be understood as an attempt to chart a path through the shifting sands of theological method, liturgical reform and the varying approaches to sacramental theology in the past two decades. Well known for his books Christian Sacraments and Christian Personality (1965) and Ministry to Word and Sacrament (1976), Bernard Cooke presents an.approach in Sacraments and Sacramentality that is grounded in human experience and everyday life. The first six chapters demonstrate how Christian sacraments are grounded in human life; the remaining chapters discuss individual sacraments and sacramental grace. Cooke states that Christian sacraments are "specially significant realities that are meant to transform the reality of the human by somehow bringing persons into closer contact with the.saving action of Jesus" (8). The present volume is welcome for a dual reason; one that it marks the resumption, after a period of over twenty years, of the scholarly translations of St. Bonaventure, begun under Boehner; the second is the intrinsic value of the translation and lengthy introduction, almost a third of the book. Since the Saint Anthony Guild and Franciscan Herald Presses have published some of the shorter and more popular writings of the saint, it is fitting that the Franciscan Institute, noted for (...) its more technical philosophical and theological studies, should have chosen this series of disputed questions. They are undoubtedly one of Bonaventure's most mature and important writings, stemming from his days as the Franciscan regent master of theology at the University of Paris. The translator has already distinguished himself with a number of other articles and translations of the Seraphic Doctor. His scholarly and informative introduction falls into three chapters, one on the historical background, a second on the originality of Bonaventure's general trinitarian theology, and the third on the specific themes treated in this set of disputed questions. The first throws new light on the origin of the Dionysian and Richardian elements that separate Bonaventure's treatment of the trinity from that of Aquinas. Bonaventure became acquainted with pseudo-Dionysius and Richard of St. Victor through the Summa fratris Alexandri attributed to Alexander of Hales and the early Franciscan Masters at the Paris house of studies. Fontal plenitude, fecundity, and goodness, that figured largely in the Greek Fathers, are developed by Bonaventure in an original and personal way. The incompleteness of the Dionysian model is filled in by Richard's psychological analysis of love and his conception of personhood. Innascibility as the key characteristic of the Father is given a positive twist; it implies one who is first in an absolute sense as the summation of Parmenidean perfection and whose fontal plenitude is not only the source of the dual procession in the Trinity, but spills over into a richly diverse and continuing creation that bears in varying degrees the stamp of its triadic source. Man as microcosm mirrors this most of all, especially that man in whom the Logos, or macrocosm of archetypal ideas, became incarnate. It is only in treatment of the Son and his relationship to creation as exemplar cause that the distinctive influence of Augustine appears. In the final introductory chapter, the specific Trinitarian themes of unity, based on a dynamic rather than a static Aristotelian notion of deity, simplicity, infinity, eternity, immutability, necessity, and primacy are discussed and what emerges is a deeper appreciation of the synthetic genius of Bonaventure, who drew from such a myriad of sources, yet wove his material into a unique system in which philosophy functions not as a propadeutic to theology, but as an integral and essential part. Despite the author’s disclaimer that his primary objective is not to settle the historical disputes over the nature of Bonaventures’s philosophy, the general conclusions at which he arrives often differ so markedly from what other’s have said on that subject that he finds it useful to conclude his independent source-study with a 56 page analysis of how far the saint’s own writings support or disprove the opinion of the historians mentioned above. Since it is impossible to even summarize more than a small slice of this detailed study in any informative way, the remainder of the review will concentrate on this concluding portion in view of its more general interest. Martin Keywords: Depression, morality, mental disorders, psychobiology, evolutionary psychiatry. In "Depression as a Mind-Body Problem," Walter Glannon outlines a psychosocial-physiological explanation of depression as a psychological response to chronic stress—today, especially social stress—in which cortisol imbalances disrupt neurotransmitters. Accordingly, treatment for depression should combine psychopharmacology and psychotherapy—a valuable reminder in light (...) of the current restrictions on funding for health care (Hobson and Leonard 2001). My comments focus, however, on Glannon's objections to evolutionary theorists who explain our capacity for depression as adaptive to the natural and social environment. His objections are implausible because he fails to distinguish depression as a mood and a disorder. What Is Depression? Explaining the psychology, sociology, physiology, and evolution of depression presupposes knowing what depression is and hence what is being explained. As a blunt but important distinction, let us contrast depression as a mood and as a mood disorder.As a mood, depression is a state of low spirits, typically involving painful and low affect (of a kind needing further specification). Not all negative low moods are depressions. It is notoriously difficult to distinguish depression from grief, sadness, gloom, and a host of additional ways to feel down—especially because today many people use "I'm depressed" as a blanket expression for virtually any low mood. For the purposes of this paper, it is not necessary to attempt a full-blown analysis of depressed moods (and emotions). I would emphasize, however, that depressed moods involve values. They involve negative evaluations of ourselves, major events in our lives, life in its entirety, or the values that have been guiding us. Typically, to be depressed is to experience such things as feelings of worthlessness, dejection about failures, despair and hopelessness, and loss of caring and commitment. Thus, we might be sad or grieving but not depressed because we retain a solid grip on what is valuable and worthwhile. In any case, there should be no general presumption that depressed moods are all bad or undesirable. Instead, we should be prepared to appreciate the importance of depressed moods in connection with questions of value, identity, and even moral insight (Martin 2000). Depressed persons are not necessarily sick.In contrast, depression as a mood disorder is, by definition, pathologic. Moreover, usually it is not a depressed mood, although it involves depressed moods. On the one hand, depression as a disorder is defined as pathologic, a notion that is itself understood in terms of values—the values of health and, indirectly, moral values that define what is culturally acceptable. Thus, even severe [End Page 255] grief can be nonpathologic, even though it involves depressed moods, when it is within the range of "culturally-sanctioned responses" (APA 2000, xxxi). He was the third of six children, and his father was a physician. His mother was the only person in the family who practiced religion, namely, Jōdo Shinshū or Shin Buddhism. As a university student, Abe attended what is now Osaka Municipal University, where he studied economics and law. (...) While at the university, he read the Tannishō, a text by Shinran. Abe later said that he understood from that text that “self-power” was futile and the only hope for salvation was “other-power” faith in the grace of Amida Buddha. However, he also understood that this life of grace entailed the relinquishment of “self-centered calculation.” Abe felt that he was not able to set aside his ego-self and began for the first time in his life to experience the tension between Buddha and ego, or, in more Western terms, the duality of God and self. This concern led Abe into a very personal spiritual quest that would define his life and work.Given this concern, after graduation, Masao Abe wanted to attend Kyōto University to study Buddhism. FurtonIn his article titled “Moral Complicity in Induced Pluripotent Stem Cell Research,” Mark T. Brown (2009) unfortunately mischaracterizes my ethical analysis of the use of induced pluripotent stem (iPS) cells for replacement therapies, or treatments (Byrnes 2008). In my paper, which Brown cites, I argue that, just as it is ethically acceptable (...) for parents to allow their children and themselves to be immunized using vaccines produced by cell lines derived from human fetuses aborted in the past, it is also acceptable for persons in the future to benefit from treatments that use iPS cells validated using human embryonic stem (ES) cell lines [End Page 202] derived in the past. The assumption I make is that iPS cells would have to be shown to be functionally equivalent to human ES cells—i.e., validated—before they could be used for cell replacement treatments. (If it turns out that this assumption is incorrect, and primate or even mouse ES cells can be used for the validation, then all residual ethical problems will disappear and there will be no ethical problems whatsoever associated with iPS cells.) I wrote:... [I]n both cases, the origin of the treatment is in a one-time event: either the one-time use of aborted fetuses to obtain cell lines (e.g., MRC-5 and WI- 38) to grow weakened virus strains for vaccine production, or the one-time destruction of human embryos to validate iPS cells, which then effectively replace embryonic stem cells. WHEN ONE ASSUMES, as I will, that death marks the irrevocable end to one’s existence, it is difficult to make sense of the idea that a person could be harmed or benefited by events that take place after her death. How could a posthumous event either enhance or diminish the welfare of the deceased, who no longer exists? Yet we find that many people have a prudential (i.e., self-interested) concern for what’s going to happen after their deaths.1 People are, (...) for instance, concerned that their reputations not be slandered, that their achievements not be undermined, and that their contributions not be forgotten, not even after their deaths. Of course, many philosophers would insist that such a concern for what’s going to happen after one’s death must be based on, or a remnant of, a false belief in an afterlife. I, however, will argue that even if death marks the unequivocal and permanent end to one’s existence, people have good reason to be prudentially concerned with what’s going to happen after their deaths, for, as I will show, a person’s welfare can indeed be affected by posthumous events. Joaquin Segura. Untitled (fig. 40) . 2007 continent. 1.2 (2011): 117-124. The interview that follows is a dialogue between artist and gallerist with the intent of unearthing the artist’s working strategies for a general public. Joaquin Segura is at once an anomaly in Mexico’s contemporary art scene at the same time as he is one of the most emblematic representatives of a larger shift toward a post-national identity among its youngest generation of artists. If Mexico looks increasingly like a foreclosed (...) home burning to the ground, Segura could likely be the one walking away, charred matchstick between thumb and forefinger and shit-eating grin on his face. His corrosive attacks on institutions, ideologies, and power reflect a deep general distrust of authority, increasingly evident within the work of younger Mexican artists. It is perhaps most directly the result of President Calderon’s deeply unpopular war against the cartels but no doubt equally the product of decades upon decades of rampant corruption and errant policy within Mexico. Brett W Schultz (BWS): A recurring—if not dominant—theme within your current work and investigation explores ideological extremism in reaction to some perceived political and economic disenfranchisement, especially that espoused and practiced by right-wing groups in United States. That's exactly why I thought of you when I was approached to contribute a piece to an issue on the subject of the moraine—taken metaphorically here to signify a certain set of beliefs that have resurfaced within mainstream American culture in the wake of a probably over-exaggerated political sea-change, marked by Obama's election. You're a Mexican artist who now lives and works in Guadalajara, far from the border cities where such concerns would seem more likely to be relevant to a contemporary artist; of course, you're even farther from the culture that birthed this nature of extremism. What interests you so intensely about this movement, if we can call it that? Joaquin Segura (JS): I think there are several seminal points that you touch on in this particular question. There's a very specific set of interests that make me address the socio-political issues I've been dissecting through my practice in the last few years. First of all, I don't really consider myself a 'mexican' artist. As I've made clear in the past, I don't really believe in the notion of 'identity' or the idea of 'nation', which I find totally laughable and heartwarmingly passé. I'm convinced that these are totally outdated models of understanding our differences and similarities, expanding our already immense and irreconcilable cultural abysses instead of bringing them together, thus resulting in their total dispersion among the complex and extremely arbitrary weaving of contemporary social nucleii. Pretty much a frankly bad joke, if I may say so. The fact that I live and work in Mexico is a completely random geographical and temporal factor, which of course affects what I think and what I do, but I've chosen not to be limited by this specific circumstance. In the past, while working abroad, I've taken advantage of this preconception of Mexico—to be more exact, pretty much all of Latin America—as one of the last barbaric bastions of western civilization. Totally amusing, if you ask me about it. I consider my practice to be, among other things, a gonzo strategy of deceit: there are quite a few roles you can adopt in this approach that may actually reveal themselves to be a privileged vantage point. In my experience, the gentle savage is one of the most effective ones to establish my standing position. Thus, I'm a mexican artist if I need it to prove my point. If it's not necessary in a specific circumstance, I'm not. Quite simple, I think. Said in other words, it's just an ace I can play to win a particular match. It has worked so far, at least for me. L: Hey, America… , 2009. R: The Inaugural Address , 2009. I am interested in the nature of power and the rise and fall of totalitarian ideological and political apparatuses nowadays. But I guess, going even further, I'm essentially fascinated by the fissures and contradictions that have made these structures spectacularly crumble to the ground. I do believe extreme ideologies have played a crucial role in the globalization of socio-political crisis. In the end, our world is nothing more than a fading monument to all things gone wrong—the inspiring triumph of failure, in every sense. I see this as an exciting parable. And of course, it is an undeniable fact that the US, through their influence in world economy, international policies and general attitude towards the rest of the planet is the largest structure waiting to collapse. I think we are all secretly awaiting that moment of splendor, even americans. It'll be disastrous and as nasty as it can get, but it will also be liberating and incredibly inspirational. Not just because it’s the US but because it'll prove that absolutely everything is susceptible to fall. And not only that, most importantly, it would confirm that radical change may actually be possible and not just one more of the unfulfilled promises modernity has left us to struggle with on our own. BWS: I want to talk first about two of your works in particular: Hey, America... and The Inaugural Address . I feel like your more recent work has a subtle —or even hidden—sinisterness, but these two works are perfect examples of how brutally confrontational your earlier work has been. When we showed Hey, America... at Mexico City's Zona Maco art fair in 2010, there were at least a couple visitors to our stand who were absolutely ready to punch me in my gringo face for having done so. Certainly the shock value of these works is crucial to their central ideas, but can you tell me more about your intentions and how these works relate to your general oeuvre? JS: So funny. Perhaps we do deserve to be punched in the face. I think that's what I'm sometimes looking for, but I hardly ever get it. I do think of such works as some sort of logical trap, a somewhat perverse ambush waiting for someone to walk into head-on. I think what I tried to do with those two specific works, as well as some other past projects, is just emphasize issues or themes that do disturb or make me uneasy and restless. I consider my essential intention a need to make clear that we do not have to look the other way, ignore or forget. We must address, understand and solve these manifestations of senseless violence and absurdity because if we don't confront them this way, they'll end up consuming us. In other words, I do consider these works as a personal need of coming to terms with the nonsense of the world we all are living in. I don't particularly consider myself to be someone with a clear set of beliefs. Perhaps my only certainty would be that everything is there to be denied, demolished and obliterated—even my supposed unquestionability of that particular 'dogma.' My practice is a reflection of that paradox, and I do think that's how these two pieces relate to a wider body of work. Every democratic system and so-called developed contemporary society is deeply flawed on the inside, and that is because each has swept things under the rug. Of course, there's tolerance, good will and eagerness to make a difference but there's also hatred, pain and fear lingering all around. We must learn to relate to both sides of the spectrum. In a way, I approach the themes behind these particular works in what I think to be a non-biased, somewhat 'neutral' way. I do think there's an encryption process going on in the way I work, some sort of formal refinement of this somewhat outrageous content. A digest of infamy, if we can refer to it that way. It is up to the individual experiencing the work to decide which way these pieces lean. They can easily be seen from both positions and I'm ok with that. If you look closely at these works, there's nothing that establishes an unrelenting position—neither support nor rejection. I don't want my personal political views to directly set an agenda for the spectator as that’s essentially propaganda, which is one of the things I absolutely despise. To sum it up, I strive for the spectator to complete the piece in that sense. The work then becomes a reflection of his or her own contradictions, a playground of the mind. I'm interested in achieving a deadpan and deadlock state in the observer. So, in a way, those visitors threatening to beat the shit out of you unconsciously became that particular issue the work is alluding to. Just blind and senseless reaction to god knows what people feel must be defended, the overwhelming virtue of ambiguity. Beautiful. Perhaps you can also think of my practice as a uber-sophisticated and snobbish version of Punk'd. And you wouldn't be far from what I'm trying to convey. Untitled (Disturbance Scenarios #2) . 2010. BWS: To me, an important transitional marker in the overall trajectory of your work is the series, Disturbance Scenarios , which evokes a similar generalized state of panic, paranoia, and impending doom through its incorporation of sensationalist newspaper headlines, yet also suggests this slyly mysterious meta-narrative via the context in which the newspaper itself is placed. How did you arrive at this series and why did you choose photorealistic painting as the medium for it? JS: I consider this series to be a by-product of the process I follow when making work. I spend an important part of my time just doing research, going through documentation and accumulating visual or historical references for the themes or episodes I'm interested in, in that particular moment. These are, of course, valuable assets that connect among themselves in a mysterious and almost undetectable manner, sometimes a few years between one and the other. I've employed similar production strategies in the past, in ongoing series like Random Moments of Urban Decay , in which I document what I consider to be physical traces of ethnic, religious or ideological violence in the form of text graffiti, invisibly scattered in different cities of the world, mostly in the US. Disturbance Scenarios was started in early 2010, following a particularly intense period of traveling here and there that lasted for most of the year. I've always felt compelled by text, as I find quite intriguing the idea of how words can create equally intense evocations of what I call a mental panorama of uneasiness than those produced by aesthetically-charged imagery; of course, if handled right. I have a close relationship to print media—due both to my academic background and to my attraction to its ubiquity and almost unlimited influence, which in the end, is nothing else but power—so I found myself with a growing archive of newspaper headlines snapshots from cities like Melbourne, Auckland, London, and LA. Going through them, I noticed that they had in common a very specific thematic slant: they were all about some sort of conflict: energy crisis, political unrest, local episodes of domestic violence, you name it. So as you very well put it, I felt they all connected through this feeling of anxiety and anguish and I decided to start thinking of them as a body of work. Basically, I felt an interest in creating what I think of as my personal fragmented prefigurements of the end of civilization. There were few elements on the shots that could give away its actual location, geographically speaking, and I liked that. I find this sensation of vagueness and uncertainty quite alluring. The more subtle, the more perverse. The formal resolution of the series—as photo-realistic painting—is linked to my intention of creating distance between me as the artist and the themes I work with. I rarely execute my own work, and that is more a personal choice as I'm more interested in the ideas I mingle with than in the actual outcome of that process, understood as an "art-object" with certain market value. I did some tests with light-jet prints of those snapshots and I found them devoid of that nightmarish, disturbing indistinctness that I felt was so important for them to be able to project the turmoil I experienced upon encountering them and in conceiving of them as a series. So I thought that photorealistic painting would be an interesting resource to play with, as I hardly had worked with that medium before because of my lenient animosity toward painters and their craft. So they were executed like that and I think it turned out to be just right. Homemade (Napalm #2) . 2010. BWS: Though Disturbance Scenarios remains ongoing, it's an interesting contrast to another series of yours, Homemade, which are these beautifully banal photographs of the ingredients used to make improvised explosives. Whereas Disturbance Scenarios still confronts the viewer aggressively with its visual emphasis on loaded texts, in Homemade , you've dropped the surface-level bravado entirely. They're pieces that require explanation to someone not already versed in the fine art of amateur explosive-making. You weren't known for subtlety in your past work; why this change in direction? JS: I'm personally convinced that these are just two angles of the same conceptual preoccupation. I mentioned before my obsession with the idea of encryption. I'm quite enticed by how these processes of translation can politically and semantically alter and deviate purportedly subversive materials such as the ones these works allude to. I do think subversion is futile. I was really troubled by that thought for some time, but I think now I understand that it's not really that important. What is really significant is to elaborate on these alternate views, to envision and refine possible escape routes. It doesn't really matter if they go nowhere, but that is because nothing really matters. A "mute" artwork is a notion that captivates me. When you look at the works you mention, you know there's something off, but it's not fully clear how and why that is. I rely on that insecurity—on that moment of hesitation. And that can also be achieved through an approach like the one I'm now interested in. Let's just call it a smoke screen, a surrogate ruse to get to the same point: to talk about impotence and defeat in contemporary life. The notion that readily accessible information is actually a weapon is a double-edged fallacy: sure, you can make use of whatever resources you can lay your hands on, but that doesn't set you free because freedom is impossible. Still, that doesn't mean you can't blow up stuff during the process, metaphorically or not. I didn't understand the nature of subtlety before. I used to think that you needed to be loud and manifest anger and unconformity in the most aggressive manner possible. Then I finally realized that you can actually permeate and rarify a battleground—because after all, this is low-intensity war—if you actually aim at silently building up the contradictions and making the symbolic value of ideas and acts clash within themselves. Or perhaps it is that I am just getting old. I guess I used to be an angry kid until recently. Now I think of myself as a disenchanted post-teenager, and of course that reflects in my work and my approach to art-making. Kind of a rite of passage and I laugh at it because, overall, it has been overwhelmingly fun. And that doesn't mean that I'm not ready to stick it in someone or something's face again if I feel like it. BWS: You're now taking the subtlety of the Homemade series even further with your newest series, Definitive Reader For a Botched Revolution , in which you photograph a series of politically-charged books side-on, negating their content entirely—essentially reducing them to purely aesthetic objects in which the subject matter is only revealed in the title of the work. Can you talk about the ideas behind this series? Furthermore, is your recent interest in this idea of the "botched revolution" an indication of a general attitudinal or philosophical shift you've since adopted? JS: This new series of works is the logical outcome of a brief period I went through. Probably the last couple years, in which due to a number of circumstances that don't really have to do with my art-making, I was forced to renegotiate my ideas, my beliefs and practically everything that surrounds me. It was quite distressful and turbulent, but in the end, I think it was also almost epiphanic. I came to terms with myself and now I'm calm and serene. That is, of course, my personal take on it but I mention it because I do think it's important to address this shift you mention. The idea of an artwork as a container for latent revelations enthralls me quite a bit. That's how I see these particular works: art as an incendiary agent. It's up to the artist and the spectator to do whatever they please with it. I think the detachment and almost surgical cleanliness from the Definitive Reader series is also my take at poking fun of the way some art is totally innocuous and uncompromising. These images may be pleasing to the eye, but there's something twisted and rotten within them, well hidden beneath. You'll either see it or not, but without a doubt, it will not cancel its presence. This series is intrinsically linked to Homemade . I'm pretty much horsing around with similar ideas and statements here. And well, yes, I do think any revolution is a botched one. There's nothing too heavy about their own downfall. Decay and breakdown are here and will not go away. Perhaps we must learn to embrace them in one way or another, for our own sake. You've got an upcoming solo show at the Sala de Arte Público Siqueiros [SAPS] in Mexico City this summer. What can we expect from that? What else do you have planned? JS: I'll go and get seafood as soon as I'm done with this interview. It's pretty good here in Guadalajara. That's my top priority at this very moment. About my solo project at SAPS, it's due to open in late July. I'm quite looking forward to it. I'm still closely working with the curator on the general feel for the show but I can say that it'll be more of a revision of past works that have not been shown in Mexico City except for a couple pieces. It definitely won't be a showcase for new projects, although we may include one or two previously unseen works. What you can expect is a rereading of what I've been working on during the past few years. In a way, that's exciting to me because for some reason I don't really care about, I'm not that active in Mexico City even though that's where I lived and work for years. I've hardly shown there after my solo project at Yautepec in February of 2010. It'll be nice to see how it all comes together and I'm more thrilled about it because I totally love the space and I think they're doing an excellent job with their programming and its direction. And in a certain way it feels like going back home. About everything else, I need a period to reflect and fully understand what I've been thinking and working on. I've got a few group shows here and there: New York, San Francisco, and Melbourne are the ones happening soon. I will present my censored project Untitled ( Gringo Loco ) as part of the programming of the Museo de Arte de Zapopan in Guadalajara, two years after being escorted at gunpoint from the installation site by police sent by the extreme right-wing mayor of the city, which I found pretty amusing for an otherwise typical Saturday afternoon. I'm also involved in a couple "curatorial" projects. In my case, "curatorial" means that I help put together stuff I like and I'm interested in. One of them will open in late September of 2011 at Arena Mexico Arte Contemporaneo, and I will work with three of whom I consider to be some of the best artists in a lively and active scene such as the one here in Guadalajara. But most importantly, I've been doing heavy research so there are also a number of projects that I've yet to finalize. That'll be my main focus during the rest of the year, even though I really enjoy procrastination. There'll be time for that later. Or maybe not. We'll see. Suppose we agree to reject the view that privacy has narrow scope and consequently is irrelevant to the constitutional privacy cases. We then have (at least) these two options: (1) We might further emphasize and draw out similarities between tort and constitutional privacy claims in order to develop a notion of privacy fundamental to informational and Fourth Amendment privacy concerns as well as the constitutional cases. We can cite examples indicating this is a promising position. Consider consenting homosexuality conducted in (...) one's home, for instance. We view it as a private matter, whether the state is seeking to regulate the behavior, or if others are attempting to gain or exploit information about it. I believe basic conceptual similarities between tort and constitutional interests can be identified by showing that there is a range of similar reasons for protecting both tort and constitutional privacy concerns. We might worry, however, that a comprehensive concept of privacy may be too general to be very useful, given that privacy violations can be so diverse, and can arise, for example, from misuse of confidential information, from conduct that is intrusive even if no information is gained or disclosed, from disturbance of an intimate relationship, or from disruption of various other important aspects of one's life.(2) We could concede that whatever “privacy” means in the tort and Fourth Amendment cases, it means something different in the constitutional cases. Nevertheless, we might take that “something else” seriously as a distinct but legitimate use of the term which is not “spurious” but is reflected in our ordinary language. This appears to me to be a fruitful alternative. After all, contrary to Henkin's view that tort privacy is “what most people mean by privacy,” the term is often used in contexts beyond informational privacy and clearly related to the interests at stake in the constitutional cases. Thus, for example, in a pamphlet explaining how to protect children by teaching them how to say “No!” to strangers without making them paranoid or antisocial, parents and teachers are told, Children have a right to privacy. Teach it. Reinforce it. One of the ways to help children prevent sexual assault is to encourage them to develop a sense of physical integrity. A sense that they have a right to their own body space and privacy. Just as we allow them to close the door when they use the bathroom, we must allow them to say no to any unwanted physical affection and touch. Unfortunately, the most obvious starting point for identifying the sense of private relevant to the constitutional cases is extremely worrisome. The Court itself has said ... only personal rights that can be deemed “fundamental”...are included in this guarantee of personal privacy...the right has some extension to activities relating to marriage...procreation...contraception...family relationships... and child rearing and education.Roe v. Wade, 410 U.S. 113 (1973).The difficulty, of course, is that little more is offered by way of explanation of which rights are “personal” or “fundamental” or both. Focusing on marriage makes Roe v. Wade difficult to understand given that Ms. Roe was unmarried, and attending only to family issues does not help us make sense of the Stanley case protecting one's right to view pornography in one's home. It is perhaps more problematic that decisions such as what color shoes to wear are reasonably viewed as personal, yet are far from fundamental enough to warrant protection. And regulations governing the draft and employment, for example, are not viewed as privacy invasions although they might be said to interfere with matters of one's life that are both fundamental and personal in the vague sense described.Before we give up in frustration, however, I would urge that we recall that even in tort law the notion of privacy has been evolving through a constellation of judgments. Although there is no fixed way of using the term which we then proceed to analyze, the concept of privacy has not in those cases been taken to be meaningless or empty. Similarly, there is reason to believe that the scope of a “personal and fundamental” notion of privacy relevant to the constitutional cases can be further delineated through a consideration of cases, especially since it seems to me that in many cases application of the term is clear and unproblematic. A decision to have a vasectomy, for example, can uncontroversially be said to be a personal and fundamental one, and it is in that sense private. We fail to acknowledge the personal significance in an individual's life of forcing or refusing him the operation if we deny that this important sense of privacy is relevant to such a decision merely because an interest in determining for oneself what one ought to do is also at risk.Of course, once it is settled that something is a private matter, it is a separate issue to decide whether or not, in some social context, an invasion of it can be justified. Thus, I would claim, a mandatory sterilization program for male recidivists or for those in a country suffering grave poverty and overpopulation does invade privacy, and the social or legal question is whether or not the invasion can, in the particular circumstances, be justified. Although all will agree that both individual and social interests must be balanced by moral philosophers as well as the courts, in conflicts we will not always agree on the weight to be accorded individual claims.I have not provided a constitutional defense for citing privacy as one right at stake in the constitutional privacy cases. Nor have I attempted to enter the debate about how strictly to interpret the Constitution. But if I am correct, then we can agree there is an important interest in privacy at issue in those cases without merely conflating privacy and autonomy or liberty, and can continue the process of marking out its boundaries. If we reach such agreement, we will have made considerable progress. Moreover, the implications of this view are significant. Current constitutional standards, controversial though they may be, require “strict scrutiny” for cases concerning “fundamental values,” and privacy has been judged to be one such value. Thus these privacy claims have a greater chance of being protected when they conflict with other rights or general interests than they would have if only liberty, or freedom from governmental interference, were involved. Philosophers who have a conception of morality that allows for an ultimate conflict between duty and self-interest inherit a most difficult problem: the problem of the unity of practical reason. As long as duty is thought of as an extension of self-interest, as apparently both Plato and Hobbes thought, no theoretical difficulty arises; practical reason is unified simply because duty and interest have the same goal. But once this kind of conceptual connection between duty and self-interest is severed, the task (...) is to avoid the philosophical nemesis of dualism, a conception of practical reason in which an individual’s choice between doing his duty and securing his interests is necessarily arbitrary as a matter of practical justification. Moreover, the difficulty is compounded when morality is conceived in such a way that a person has a morality only if his moral concerns have justificatory priority among his practical concerns. When built into the concept of morality, this sort of justificatory priority might initially appear to restore the unity lost by practical reason with the severance of duty and interest. But so achieved, the unity bears all the marks of having been gained arbitrarily, for it can just as plausibly be said that a person is an egoist only if his own interests take justificatory priority among his practical concerns. Faced then with a decision about what he ought to do in a situation in which duty and interest are in conflict, the practical reasoner confronts a dilemma. In trying to decide what he ought to do, practical reason, in the form of morality, advises him to do one thing, yet in the form of self-interest, it advises him to do another. Therefore, like Humpty Dumpty, once practical reason is shattered by the separation of duty and interest, the practical reasoner’s problem is how to put things back together again. (shrink)

In a just society a person's possessions and consumptions are not on the minds of the other people with whom they meet and treat. When Odysseus came home he was delighted to climb into a peasant's cart to ride the last mile home. Contrast this king with King Arthur riding with another peasant on another road, choking with the anxiety that he may not be acting kingly by being in the cart.
